Development Services

We have years of hands-on experience

Our team of development specialists, have a wealth of experience and knowledge placing us in the best position to give you the best possible advice on your development project.

As part of our development services, we would normally be involved in the conduct of matters from initial development appraisals, site assembly, negotiation of planning highways and utility agreements, through to plot sales or leases.

A White Elephant?

Development work needs the utmost due diligence with careful consideration to all the factors that can potentially turn a successful development into a ‘white elephant’. Only when we have considered and eliminated all obvious risks (or worked out a strategy for dealing with manageable risks) should a developer proceed.

Development problems and solutions

Whilst acting for developers and funders we have come across most of the associated pitfalls including:

  • Ransom strips
  • Absence of Rights of way or other necessary rights
  • Restrictive covenants
  • Unreasonable or unrealistic planning conditions/planning agreements
  • Badly drafted overage agreements
  • Boundary issues

With increased pressure on the availability of land comes increased opposition to development. We also have considerable experience of advising clients on problems affecting developers including:

  • Enforcement of restrictive covenants
  • Adverse possession
  • Listing of  Assets of Community Value
  • Town and Village Greens
  • Rights of way
