Children and vulnerable adults can be compelled or forced into committing criminal offences. The Modern Slavery Act exists to protect them, even when they may not regard themselves as victims or slaves, and to provide a defence to many criminal offences.
As well as creating offences of slavery and trafficking others, the Modern Slavery Act provides a defence for those who have been compelled because of slavery or exploitation.
We have considerable experience of representing those who are the victims of modern slavery and achieving positive outcomes for our clients whether children or adults. We can assist with referrals being made to the Single Competent Authority under the National Referral Mechanism. We will look to instruct suitable experts and where appropriate put forward a defence at trial under s45 of the Modern Slavery Act 2015.
