Simon Mullings acted for the appellant in a case where the Court of Appeal has held that the effect of an agreement, under which the appellant was temporarily decanted from her home, was that the appellant ceased to be a tolerated trespasser and became a secure tenant. The decant agreement was premised on the appellant being a secure tenant at the relevant time. It expressly granted her a secure tenancy of the temporary accommodation and provided that the tenancy of her home would continue until her home was ready for her to move back.
