Kris joined Edwards Duthie Shamash’s Court of Protection department as a solicitor in January 2023, and has over eight years’ experience of specialising in Court of Protection and Community Care law. Kris has been ranked as an ‘Associate to watch’ in Chambers and Partners, 2024.

Kris is regularly instructed by the Official Solicitor to represent vulnerable adults who are involved in Section 21A Deprivation of Liberty Mental Capacity Act 2005 proceedings, and also in more complex cases to determine the client’s capacity in relation to various issues. Kris has experience dealing with deprivation of liberty cases, residence, care, contact, and marriage issues, cases with medical treatment aspects, committal applications, applications regarding the revocation of LPAs and the appointment of deputies, hybrid health and welfare and property and affairs matters, urgent applications in relation to protective measures concerning client’s property and affairs and leaving the jurisdiction, and has also been involved in cases dealing with applications made by the press regarding the publication of case information.

As well as often being instructed by the Official Solicitor, Kris has been instructed by family members in Court of Protection and Community Care matters, in particular challenges to Continuing Healthcare decisions, and has also been instructed by advocates and RPPRs to bring deprivation of liberty challenges.

Kris has also advised on safeguarding concerns, section 117 aftercare, matters relating to the Human Rights Act 1998, matters in the Court of Protection concerning the interface between the Mental Capacity Act 2005 and the Mental Health Act 1983, the transition from Children’s Act 1989 to Mental Capacity Act 2005, housing rights and local authority obligations, and matters under the inherent jurisdiction of the High Court,
