R (Ethos Recycling) v Dagenham Magistrates’ Court

Edwards Duthie Shamash was involved in a landmark decision in the Administrative Court as to the definition of “summary proceedings” as it applies to the Environmental Protection Act 1990.  This was an important case which was dealt with in behalf of our clients, the London Borough of Barking & Dagenham. The judgment established for the first time the definition of this important phrase.  The implications of the case go beyond its impact on the parties involved.  The decision was keenly awaited by a number of professional bodies, local authorities and the Environment Agency.  The person who had conduct of the case and appeared as the advocate in the Administrative Court was the Senior Partner of Edwards Duthie Shamash, Shaun Murphy.
