The Law Commission declares that Sentencing Law is too complicated
The Law Commission have embarked on a process of consultation to simplify the sentencing provisions which are available to Judges and Magistrates in criminal cases.
It is estimated that Sentencing Law is contained over 1,300 pages and spread across 48 different Acts of Parliament. Often it is drafted in languages which are updated and unclear. As a result, the sentencing process takes far longer than may be necessary. The Commission has also pointed out that in a third of sentencing appeals in the Court of Appeal (Criminal Division) it was noted that sentences were completely wrong in law and Judges were routinely making mistakes.
