A boy who suffered heart failure as a result of a delay in diagnosing his medical condition has won compensation that could run to millions of pounds.

Shoaib Dawlatshahi, who was nearly three years of age at the time of his illness, was admitted to the Lister Hospital after suffering from a high fever and vomiting for three days. Doctors failed to diagnose the condition Viral Myocarditis – inflammation of the heart muscle – and Shoaib suffered three cardiac arrests. Although he was resuscitated each time his heart stopped, he was deprived of oxygen and was left with permanent brain damage.

As a result, Shoaib, now nine years old, has been left with stroke-like injuries. He has serious problems in moving his right arm and leg and also has moderate learning difficulties.

Shoaib’s father, Naveed Dawlatshahi, brought a claim for compensation against the East and North Hertfordshire NHS Trust, claiming the hospital had been negligent in its treatment of his son. The Trust admitted liability and agreed a settlement, which was made up of a substantial lump sum plus index-linked periodical payments. The compensation will help provide for a lifetime of care. The precise details of the settlement were not made public, but the total is likely to be worth several million pounds.
