Shabaz is an experienced and highly respected criminal law specialist with over 20 years’ experience in all areas of Criminal Defence litigation and advocacy. He has extensive experience in defending those involved in criminal proceedings and has advised clients on all types of cases ranging from simple cases to complex proceedings relating to allegations of Murder, complex multi-handed drugs cases, fraud and sexual offence allegations.

Notable Cases

Notable Cases – Murder

R -v- AK – (Snaresbrook Crown Court) – AK was charged with Attempted Murder following an allegation that AK had shot another man in the chest. AK pleaded Not Guilty to the charge and Shabaz was able to persuade the prosecution to accept pleas to a lesser charge and drop the charge of Attempted Murder.

R –v– DM & Others (Central Criminal Court) – Successfully defended a murder charge at the Central Criminal Court, resulting in Not Guilty verdicts. Shabaz was both the solicitor and  Advocate in the case (led by Kings Counsel) which was tried at the Old Bailey. Others were convicted and received life sentences. Read more about this case here.

R –v– RL & Others (Reading Crown Court) –Successfully defended RL who was charged with Murder alongside a number of other defendants in complex and serious proceedings. RL was found Not Guilty of Murder, Shabaz having successfully persuaded the prosecution to accept a lesser charge. Others were convicted and received life sentences. Read more about this case here.
 
R –v– JL (Wood Green Crown Court) – Shabaz represented the defendant who was charged with an attempted Murder. After a four week trial, JL was found Not Guilty of Attempted Murder.
 
R –v– FM Central Criminal Court (Old Bailey) – Shabaz represented as solicitor and Advocate (led by Kings Counsel)  FM who was charged with conspiracy to Murder three people following a planned shooting of three men in Ilford. FM faced a total of 35 separate charges including conspiracy to Murder, possess firearms with intent to endanger life, arson, robbery etc. The case was extremely complex and involved extensive cell-site, CCTV, ANPR and telephonic evidence. The case was tried by a High Court Judge over a three-month period. FM was found Not Guilty of Murder and all of the associated charges. Read more about this case here.

R -v- MH – Central Criminal Court – MH was charged with Murder following CCTV capturing him stabbing the victim in the case 35 times on camera in front of dozens of witnesses. MH accepted he was the stabber but relied upon a technical legal defence. Shabaz fully prepared the case and instructed very senior Kings Counsel to represent MH at trial. MH was found Not Guilty of Murder, and received instead a four-year sentence of imprisonment for Manslaughter.

R -v- AA & Others – Central Criminal Court – Shabaz represented AA in complex proceedings at the Central Criminal Court involving a quadruple shooting in which two people were killed and two serious injured. The case was extremely serious and tried by the most senior Judge at the Central Criminal Court.

R -v- AB & Others – Basildon Crown Court – Shabaz represented AB who was accused of murdering the victim by stabbing him following a road rage incident.

R -v- SK & Others  – Central Criminal Court – Shabaz represented SK who was charged with the Murder of an individual that was stabbed to death during a robbery.  SK denied the Murder and was eventually found Not Guilty of Murder by the jury after trial. Read more about this case here.

Notable Cases – Serious Violence/Firearms Offences

R -v- KF & Others – Kingston Crown Court – KF was charged with possession of a firearm with intent to endanger life following a shooting outside the Ricco Nightclub in West London. KF was accused of bringing guns to the vicinity of the nightclub, shortly before the guns were produced and fired into a crowd of people.
Shabaz represented KF and after a careful analysis of the evidence was able to prepare the Defence case to explain KF’s movements. Despite KF accepting he was the person on CCTV delivering the guns to others, he was found Not Guilty (after two trials) of possession of a firearm with intent to endanger life as well as possession of firearms. R -v- IH – Snaresbrook Crown Court – Shabaz represented IH who was arrested after a warrant was executed at his home address and a firearm and drugs were found. Shabaz successfully challenged the legality of the search, and the prosecution discontinued the case against IH.

R -v- RK – Snaresbrook Crown Court – Shabaz represented RK who was accused of being a wholesale supplier of firearms. Evidence presented by the prosecution suggested that he had been responsible for selling firearms to others. Despite three firearms being found in RK’s home address and evidence on his telephone that he had sold at least three others, Shabaz (with the assistance of experienced Counsel) was able to persuade the Court to pass a sentence of seven years, which was an excellent result given RK could have a received a significantly longer sentence for supplying six firearms.

R -v- WA – Snaresbrook Crown Court – Representation of a vulnerable woman with longstanding mental health issues who was exploited by a gang to look after firearms for them.

Notable Cases – Drugs

R -v- MK & others – Snaresbrook Crown Court MK was charged with being involved in two conspiracies to supply Class A drugs in complex proceedings involving 19 defendants. The allegations stemmed from  significant police investigation which relied upon cell-site, telephone records, covert police observations, DNA, ANPR and forensic evidence in a complex investigation that lasted months. MK disputed being involved in the two conspiracies to supply drugs, despite being present whilst drugs were supplied to an undercover policeman. Shabaz undertook significant work on behalf of MK and demonstrated that MK was not involved in the drugs supply offences. MK was the only defendant (out of the 19 arrested) that was found Not Guilty at trial.

R – HO & others – Snaresbrook Crown Court – Shabaz represented HO, said to be the “kingpin” of a drugs gang that had supplied class A drugs throughout London. HO was said to be the leader of the gang. The case was complex involving 28 other defendants.

R -v- FM & others – Winchester Crown Court – Shabaz represented FM in complex drugs proceedings relating to Operation Venetic and the police investigation into the EncroChat network.  FM was charged alongside a number of others for being involved in a conspiracy to supply 4,500 kilos of class A drugs.

R -v- PB & others – Snaresbrook Crown Court – Following Operation Venetic, prosecution of PB for being involved in the supply of multi kilos of class A drugs and firearms

R -v- TM – Caernarfon Crown Court – Shabaz represented TM in what was described as the largest conspiracy to supply steroids in the history of the UK. The case involved 22 defendants and over a million pages of evidence.

R -v KS & HS – Exeter Crown Court – Complex County lines drugs case, which also related to one of the first ever prosecutions in the UK for offences under the Modern Slavery Act.

Notable Cases – Fraud and Money Laundering

R – YA & Others – Southwark Crown Court – Shabaz represented YA, one of 24 defendants charged with a complex fraud relating to “alcohol bonded warehouses” and the fraudulent evasion of tax duty of alcohol valued at over £25 million. The case was extremely complex with the prosecution serving almost a million pages of evidence. YA was eventually found Not Guilty.

R -v- SM – Snaresbrook Crown Court – Case involving a “master forger” of identity documents investigated by the National Crime Agency (NCA). SM was accused of having a factory operation producing on an industrial scale fraudulent identity documents that were described as some of the best forgeries the police had ever seen. SM was said to be the mastermind behind the operation.

R – VP – Snaresbrook Crown Court – VP was said to be involved in the fraudulent importation of tobacco on an industrial scale from abroad without paying excise duty. The case was investigated and thoroughly prosecuted by the HMRC. Shabaz was able to demonstrate VP’s limited involvement and that VP had fraudulently imported £300,000 worth of tobacco as opposed to about £700,000 which HMRC were alleging. By carefully preparing the case and presenting VP’s position in the best possible light (given the evidence was overwhelmingly strong) Shabaz was able to persuade the Court to impose a suspended sentence order rather than an immediate custodial sentence, despite the high value of fraud accepted by VP.

R -v AH – Reading Crown Court – MA was accused of “people smuggling” by facilitating the illegal entry of people into the UK using boats and other covert methods. The case was complex involving a number of defendants and  was investigated by the National Crime Agency (NCA). MA was found Not Guilty by the jury at trial, following meticulous preparation and presentation of the Defence case. Read more about this case here.

R -v- TA – Southwark Crown Court – Shabaz represented TA who was one of 13 defendants linked to a “boiler room” fraud where it was alleged the defendants were selling fictious investments to members of the public.

Notable Cases – Sexual Offences

R –v– TT Snaresbrook Crown Court – Shabaz represented TT in complex proceedings relating to allegations of rape and sexual assault made against TT by a young complainant. TT denied the allegations and the case was extremely sensitive and difficult. Having investigated matters I some detail and having sought disclosure of evidence from a number of sources, Shabaz was able to demonstrate that the complainant was not a credible witness and had made allegations against others that were untrue. The prosecution eventually conceded that the complainant was not a credible witness and discontinued the numerous charges that TT faced and was due to be tried for at Snaresbrook Crown Court.

R-v- SA – Southwark Crown Court – Extremely complex proceedings involving 46 charges of rape and sexual offences made by seven different complainants. The proceedings involved thousands of pages of evidence, particularly digital data in the form of telephonic and computer downloads which had to be studied extensively.
 
R-v HW – Snaresbrook Crown Court – Complex proceedings relating to allegations of rape made by three women against HW. Shabaz was both solicitor and advocate in the proceedings, led by a leading barrister.

R –v– NH Snaresbrook Crown Court – Shabaz represented NH who was accused of rape by an Escort NH met on the internet. NH was found Not Guilty at trial.
