The rules for eligibility are set by the Legal Aid Agency. Whether you qualify for Legal Aid is firstly determined by the nature and seriousness of the charge you face and the likely outcome of your case if you plead or are found guilty and then secondly, by your income.
The rules on financial eligibility differ depending on whether your case is dealt with in the magistrate’s court to crown court.
